A2035, which is being sponsored by Assembly Majority Leader Greenwald (D-6) and Assembly Minority Leader Bramnick (R-21), would make several revisions to the law concerning motor vehicle franchises.

 

NJCJI is specifically concerned with the damages that would be available under the act, and the retroactive application of the act to existing franchise contracts. The most recent version would provide for a discretionary multiplier of up to three times actual damages, plus attorney fees and court costs for prevailing franchisees.

 

We will continue to monitor this issue and work with the bill’s sponsors and the broader coalition of interested groups as this legislation moves forward. It was passed by the Assembly Commerce and Economic Development, but referred to the Assembly Appropriations Committee for further consideration.
