Fighting Fraud with the Consumer Fraud Act

One of our complaints about New Jersey’s Consumer Fraud Act is that it is overly broad – encompassing many disputes that could resolved more efficiently by other means. We frequently oppose bills that would add to the already cumbersome Act, so it surprised many when came out in support of a recent bill expanding the CFA.

Chief Justice Rabner to Discuss Complex Commercial Litigation at NJ State Bar Event

Since January 1, businesses in New Jersey have had the opportunity to opt in to a new complex commercial litigation program in disputes where the damages are projected to exceed $200,000. New Jersey Supreme Court Chief Justice Stuart Rabner will provide an update on the complex commercial litigation program, and discuss the need for lawyers with such backgrounds to seek appointments to the bench at a free event hosted by the New Jersey State Bar Association on Tuesday, October 20.

Is NJ’s Legal Climate Worsening? New Study says Yes

The U.S. Chamber of Commerce’s Institute for Legal Reform has released its latest survey of state legal climates. Unfortunately, New Jersey’s ranking fell to 38 this year, down from 32 in 2012 when the survey was last released. This is cause for anxiety in a state that is struggling to grow its economy since the survey also found that “75 percent of attorneys at U.S. companies say a state's lawsuit environment is likely to impact important business decisions at their company, including where to locate or expand.” That is an 18 percent increase from eight years ago, and an all-time high.

What do we Mean When we say Government Enforcement has been Outsourced?

When most people think consumer fraud protection they imagine government agents going out into the field to inspect businesses, write tickets, and shut down bad-actors. As reports from the state Attorney General’s office can attest, these things do happen, but they are just one part of the state’s enforcement mechanism. A wide variety of regulations are also enforced via lawsuits brought by private attorneys effectively deputized as government enforcement agents.
